데이비드 올턴(David Alton) 영국 상원의원이 자국 정부에 ‘대북 전단 금지법’(남북 관계 발전법 개정안)과 관련해 한국 정부에 재고를 요청하라고 촉구했다. 우리 정부가 대북 전단 금지법을 강행 처리한 뒤 미국 조야(朝野)를 중심으로 ‘인권과 표현의 자유를 무시한 처사’라는 비판이 커지는 흐름에 영국도 동참하는 모습이다. 이날 더불어민주당은 “한국 내정에 대한 훈수성 간섭이 도를 넘고 있다”고 반발했다. 이번 파문이 문재인 정부와 미국을 주축으로 한 자유민주 진영 전체의 대결 구도로 비화할 조짐까지 보이고 있다.

 

본지 취재를 종합하면 올턴 의원은 20일(현지 시각) 영국 의회 내 ‘북한 문제에 관한 초당파 의원 모임(APPG NK)’을 대표해 도미니크 라브 영국 외무장관에게 질의 서한을 보내 대북 전단 금지법에 대한 관심과 함께 입장 표명을 촉구했다.

올턴 의원은 서한에서 법안 내용을 상술하며 “문재인 대통령이 이 법을 승인하면 한반도에서 북한 인권을 증진하고 유엔인권선언이 보장한 인간으로서 존엄성을 보장할 수 있는 플랫폼은 사라지게 된다”고 했다. 이어 “한국에 정착한 3만3000여 탈북민에게도 지대한 사회적·정치적 불안을 야기할 것”이라고 우려했다.

올턴 의원은 영국 정치권의 대표적 지한파로, 20년 가까이 북한 인권 증진을 위한 활동에 천착해왔다. 지난해 11월 문재인 정부가 탈북 선원 2명을 강제 추방하자 이를 ‘베를린 장벽 너머 확실한 죽음(certain death)으로 보내는 행위’에 비유하며 강도 높게 비판했다.

올턴 의원은 “영국은 한반도에서 평화·인권을 증진하기 위해 오랜 기간 노력해왔고, 여왕이 6·25 때 수만명을 파병하며 희생을 감수한 것도 같은 이유”라며 “한국 정부가 이번 법안을 재고할 수 있도록 영국이 노력하길 희망한다”고 했다. 이에 따라 영국 정부도 조만간 이번 법안을 비판하는 목소리를 낼 것으로 전망된다.

 

지난 14일 국회 본회의에서 민주당 주도로 법안이 통과된 지 1주일이 지났지만, 미국을 비롯한 국제사회에선 대북 전단 금지법을 비난하는 목소리가 갈수록 커지는 모습이다.

로버트 킹 전 미 국무부 북한 인권 특사는 APPG NK가 최근 주최한 청문회에서 “대북 전단 금지법이 미국에서 지지를 받지 못하고 있다”며 “문재인 한국 대통령은 법안에 서명을 거부하는 방안을 고려해야 한다”고 했다. 호주 대법관을 지낸 마이클 커비 전 유엔 북한인권조사위원회(COI) 위원장은 “미국인들이 끊임없이 강조하는 게 언론∙출판∙집회의 자유를 보장한 수정헌법 1조”라며 “전단 금지법 같은 조치가 미국의 바이든 행정부 정책과 충돌을 야기할 수 있다”고 했다.

하지만 민주당은 이날 대변인 명의 브리핑에서 “대북 전단 살포 규제는 대한민국 국민의 생명과 안전을 지키기 위한 최소한의 장치”라며 “미 정치권 일각의 편협한 주장에 대해 깊은 유감을 표한다”고 했다. ‘남북 관계 특수성을 전혀 이해하지 못한 발언’ ‘동맹국에 대한 예의가 아니다’ ‘미국의 대북 전단 후원금이 제대로 쓰이고 있는지 먼저 살피라’는 말까지 나왔다.

이번 법안을 두고 미국에서 ‘문재인 정권의 민주주의’를 근본적으로 의심하는 목소리까지 나오자 신경질적 반응을 보인 것이다. 앞서 강경화 외교부 장관도 CNN 방송에 출연해 “표현의 자유는 절대적인 것이 아니다”라고 했다.

민주적 가치를 최우선 외교 원칙으로 내세우는 바이든 행정부의 출범을 앞두고 인권 문제가 한·미 갈등의 뇌관으로 떠오르는 모양새다. 앤드루 여 미 가톨릭대 정치학과 교수는 미국의 소리(VOA) 방송 인터뷰에서 “미국, 특히 의회의 반응을 보면 정말 나쁜 상황으로 가고 있다”고 했다.

미국에선 지난 11일 의회 내 초당적 기구인 ‘톰 랜토스 인권위원회’ 위원장을 맡고 있는 크리스 스미스 연방 하원의원(공화)을 시작으로 마이클 매카울(공화), 제럴드 코널리(민주) 의원이 법안 수정을 요구하며 비판 대열에 가세했다. 올리비아 이노스 헤리티지재단 연구원은 미 경제∙경영 전문지 포브스 기고에서 “미국의 새 행정부는 개정안에 대한 반대의 뜻을 전달해야 한다”고 했다.

이런 가운데 빅터 차 미 전략국제문제연구소(CSIS) 한국 석좌는 “제이크 설리번 국가안보 보좌관 내정자가 이미 언급한 위구르 무슬림 탄압, 홍콩 문제에 대해 한국 정부는 완벽하게 침묵하고 있다”며 “바이든이 선택을 강요할 경우 한국은 D10(민주주의 국가 협의체) 같은 다자 연합에서 소외될 가능성이 있고, 이는 한국에 손해”라고 했다. 차 석좌는 한국이 다자 안보 협의체 쿼드(Quad)나 중국 IT 기업을 배제하는 ‘클린 네트워크’에 입장을 유보하고 있는 점도 언급했다.

Representations Made To the UK Foreign Secretary about the Republic of Korea’s “Gag Law”

Dear Foreign Secretary,

We are writing to bring to your attention and with our grave concerns legislation which was passed by the National Assembly on 14 December 2020 in South Korea, to amend the Inter-Korean Relations Development Act. This amendment is now awaiting the signature and approval of President Moon Jae-in.

If enacted, the amendment would criminalize the distribution of materials or broadcasting via loudspeakers and posting of placards information directed at North Korea in the inter-Korean border areas. Such materials would include leaflets, USB flash drives, CDs, books, and Biblical materials to North Korea through third countries, such as China without governmental approval. The amendment reads as follows:

• The term “leaflets, etc.” means leaflets, goods (including promotional and propaganda materials, print materials and auxiliary storage devices), money or other property interests.
• The term “dissemination” means the act of distributing to unspecified multiple persons in North Korea or moving to North Korea leaflets, etc. (including simply moving leaflets, etc. via a third country. Hereinafter the same shall apply) for the purpose of propaganda and gift, etc. without approval in accordance with article 13 or article 20 of the Inter-Korean Exchange and Cooperation Act Article 25 (Penal provisions) (1) Any person who violates Article 24 (1) shall be punished by imprisonment for not more than three years or by a fine not exceeding thirty million won; provided that the same shall not apply to cases where the effect of the inter-Korean agreements (limited to the ones that stipulate the prohibited act under each subparagraph of Article 24 (1)) has been suspended in accordance with article 23 (2) and (3).For more details on this amendment, please find the attached briefing of the Development of the inter-Korean Relations Act.

The purpose of this bill is to silence North Korean human rights and religious activities and voices from South Korean soil, in pursuit of the development of improved inter-Korean relations. However, sacrificing such basic freedoms and criminalizing activities that promote democracy and human rights are not the right approaches to inter-Korean relations, especially given South Korea’s democratic constitutional rule of law, based on protection for basic human rights of freedom of speech, expression, and religion or belief.

If this bill is signed into law by President Moon Jae-in, there are no more platforms on the Korean peninsula for promoting North Koreans’ human rights and dignity as enshrined in the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights. This is a great undermining of the recognition of the inherent dignity and of the equal and inalienable rights of all members of the democratic family is the foundation of freedom, justice, and peace. Moreover, this will cause great social and political insecurity for over 33,000 North Korean escapees residing in Seoul, despite their status as recognized South Korean nationals under the one Korea policy.

We understand that the United Kingdom continues to support the peace building process and human rights on the Korean peninsula. This was one of the reasons Her Majesty’s Government had provided tens of thousands of British soldiers and suffered thousands of casualties during the Korean War of 1950-53. Unfortunately, Korea’s division remains until today and the human rights violations and nuclear development in the DPRK cause great security tension and peace threats in the Asian Pacific and beyond.

Given the British Government’s efforts to address the current situation in Korea, we urge you to speak out regarding these concerns about the amendment to the Inter-Korean Relations Act, and to raise these issues with the Government of the Republic of Korea as a matter of urgency. As a UN Security Council Member and a leading proponent of sanctions on the DPRK in view of the regime’s nuclear program and human rights violations, we hope the United Kingdom will urge South Korea to reconsider this amendment.
